Standard Terms and Conditions

The Client agrees to be examined by a licensed physician, nurse practitioner, or physician’s assistant selected by the Client within 24 hours of the first day of service as described in paragraph 2 of the Recovery Services Agreement (“Agreement”).

No medication shall be prescribed by the ERC nurse. All medication orders will be given and overseen by a licensed physician, nurse practitioner, or physician’s assistant selected by the Client. The Client is responsible for taking prescribed medications.

The ERC nurse assigned to work with the Client will have access to the living environment of the Client twenty-four hours per day during the term of the Agreement. The ERC nurse will be either on site or within fifteen minutes proximity to the Client’s home or environment, as determined to be appropriate by the ERC nurse.

Payment of all medication, medical services, and all other products or services provided to the Client by third parties shall be the responsibility of the Client and shall be paid by the Client directly to such third parties.

Within 10 days of receiving an invoice from ERC, the Client shall pay ERC all monies owed for reimbursable expenses and the per diem rate as described in paragraph 3 of the Agreement.

Either party may terminate the Agreement without prior notice. If the Client terminates the Agreement before the end of the period of service described in paragraph 2 of the Agreement for any reason whatsoever, the Client shall not be entitled to a refund of any portion of funds paid to ERC and the Client shall pay to ERC all monies due for reimbursable expenses within 10 days of termination of the Agreement. If ERC terminates the Agreement before the end of the period of service described in paragraph 2 of the Agreement, the Client agrees to pay for the services provided by ERC up to the date of termination, such amount not to exceed the fixed sum stated in paragraph 3 of the Agreement, plus expenses. In this case, the Client agrees to pay for the services at the per diem rate described in paragraph 3 of the Agreement, plus reasonable travel, lodging and meal expenses.

The parties intend ERC to be an independent contractor in the performance of these services. ERC shall have the right to control and determine the method and means of performing the services provided under the Agreement. ERC retains the right to perform nursing and recovery services for other clients.

Except as may be required by law or as may be required by ERC to defend or assert its rights under the Agreement, the identity of the Client and the services provided during the term of the Agreement are to be treated as confidential by ERC unless the Client grants written permission to the ERC to disclose such information. The Client hereby grants ERC permission to discuss such matters with the Client’s physician and other medical and substance abuse providers involved in the Client’s care and recovery.

Any modification to the Agreement must be in writing and signed by both the Client and ERC.

The Client agrees that the services provided by ERC do not involve the diagnosis or treatment of medical or psychiatric disorders and that the recovery services provided by ERC are not a substitute for medical or psychiatric treatment. The Client agrees to consult with his or her medical professional regarding the advisability of working with ERC before doing so.
- The Agreement shall be governed by, construed, and enforced in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws provisions. Any suits to enforce rights and obligations under the Agreement shall be brought in a court of competent jurisdiction within the Commonwealth of Massachusetts.
